Terms and Conditions

1. Definitions

• Service: The hirecraft.io website and all associated services, including the candidate and recruiter modules, whether free or paid.
• User: Any individual or entity that accesses or uses the Service.
• Candidate: A User who uses the Service to generate resumes, match them to job descriptions, and receive job analysis reports.
• Recruiter: A User who uses the Service's recruiter module to manage profiles, rank candidates, and assess fitment with job descriptions.
• Content: Any text, data, information, graphics, or other materials generated, provided, or uploaded by Users or by the Service.
• Subscription: A paid plan or service tier that grants a User access to specific paid features of the Service.

2. User Accounts and Registration

• 2.1. To access certain features of the Service, you must register for an account. You agree to provide accurate, complete, and current information during the registration process and to update such information to keep it accurate, complete, and current.
• 2.2. You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your password or account. We cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

3. User Obligations and Prohibited Conduct

• 3.1. You agree to use the Service only for its intended purpose. You will not use the Service for any unlawful or fraudulent purpose, to transmit any Content that is illegal, harmful, or defamatory, or to interfere with the proper functioning of the Service.
• 3.2. You are solely responsible for the Content you upload, including but not limited to resumes, job descriptions, and personal information. You represent and warrant that you have all necessary rights to upload such Content and that it does not infringe on any third-party rights.
• 3.3. You agree not to attempt to reverse engineer, decompile, or disassemble any aspect of the Service, nor to create any derivative works based on the Service.

4. Recruiter Module Terms

• 4.1. Recruiters are granted a license to use the Service to manage and rank profiles, compare them to job descriptions, and receive fitment scores.
• 4.2. Recruiters agree to use the Service in a fair and non-discriminatory manner. The Service's scoring and ranking tools are for informational purposes only, and you are solely responsible for making final hiring decisions.
• 4.3. Recruiters agree not to use the Service to access or process personal data in violation of any applicable data protection laws.

5. Candidate Module Terms

• 5.1. Candidates are granted a license to use the Service to generate resumes, receive job analysis reports, and assess their fitment for job descriptions.
• 5.2. WHILE THE SERVICE IS DESIGNED TO ASSIST IN CREATING "ATS COMPLIANT" RESUMES AND PROVIDE FITMENT ANALYSIS, WE MAKE NO REPRESENTATION, WARRANTY, OR GUARANTEE THAT ANY RESUME OR OTHER CONTENT GENERATED BY THE SERVICE IS, IN FACT, COMPLIANT WITH ANY SPECIFIC APPLICANT TRACKING SYSTEM OR WILL RESULT IN ANY PARTICULAR OUTCOME, INCLUDING BUT NOT LIMITED TO, INTERVIEW INVITATIONS, JOB OFFERS, OR CAREER ADVANCEMENT. You acknowledge that the Service's analysis and recommendations are based on the Content you provide and should be used as a guide, not as a definitive statement of your qualifications.

6. Payment and Subscriptions

• 6.1. The Service offers both free and paid features. The specific features available for each tier are described on our website.
• 6.2. If you choose to purchase a Subscription, you agree to pay the fees specified for that Subscription. All fees are in the currency specified and are non-refundable unless otherwise stated in these Terms.
• 6.3. Subscriptions will automatically renew at the end of each billing cycle unless you cancel them before the renewal date.

7. Intellectual Property

• 7.1. All intellectual property rights in the Service, including its design, code, graphics, and trademarks, are the exclusive property of Normality Technologies Private Limited.
• 7.2. You retain all ownership rights to the Content you upload to the Service. However, by uploading Content, you grant us a worldwide, non-exclusive, royalty-free, sub-licensable, and transferable license to use, reproduce, distribute, and display the Content for the sole purpose of operating and improving the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR ACCURATE. YOUR USE OF THE SERVICE IS SOLELY AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL NORMALITY TECHNOLOGIES PRIVATE LIMITED BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE LEGAL THEORY UNDER WHICH SUCH LIABILITY IS ASSERTED.

Our total liability to you for any and all claims relating to the Service shall not exceed the amount you have paid us for the Service in the last Six (6) months, or, if you have not paid us anything, one hundred Indian Rupees ($1.50).

10. Indemnification

You agree to indemnify, defend, and hold harmless Normality Technologies Private Limited, its affiliates, and its and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising from or in any way related to your use of the Service, your Content, or your breach of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for any reason, including but not limited to a breach of these Terms.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts located in Kerala, India.

13. Miscellaneous

These Terms constitute the entire agreement between you and Normality Technologies Private Limited regarding the Service. If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
